Terms of Use#
Last updated: 10 October 2026
1. About These Terms#
Welcome to MailaAI. These Terms of Use (“Terms”) are the agreement between you and MailaAI (“MailaAI”, “we”, “us”, or “our”). They apply to everything we offer: our websites, apps, APIs, software, and tools, which we call the “Services” in this document.
When you start using the Services, you agree to these Terms, and they become a legally binding agreement between us. That is true whether you sign up for an account, use our API, or simply visit our website. If you do not agree, please do not use the Services.
These Terms explain what you can expect from us, what we expect from you, and what happens if something goes wrong. They cover acceptable use, ownership of content, payments, privacy, liability, and how we resolve disputes. We have tried to write them in plain language, and we encourage you to read them in full.
Two other documents are part of this agreement: our Privacy Policy, which explains how we handle your personal data, and our Acceptable Use Policy. By agreeing to these Terms, you also agree to follow them.
Here is what this document covers:
2. What You Can Expect From Us#
Before we ask anything of you, here is what we commit to. We will:
- Work to keep the Services available, reliable, and secure
- Give you clear and accurate information about the Services and what they cost
- Answer your questions and support requests promptly and professionally
- Respect your privacy and handle your personal data as described in our Privacy Policy
- Let you know about important changes to the Services or these Terms
3. Changes to These Terms#
Laws, technology, and our business all change over time, so we may need to update these Terms. When we make an important change, we will let you know by email, through the Services, or by posting a notice on our website. We will give you reasonable time before the new Terms take effect. For some major changes, we may ask you to accept the new Terms before you can keep using the Services.
If you keep using the Services after the new Terms take effect, you accept them. If you do not agree with the changes, you should stop using the Services. It is a good idea to check this page from time to time.
We also update the rest of our website regularly. We try to keep it accurate and up to date, but we cannot promise that all information on it is complete or current, and we are not obliged to update it. If you rely on information from our website, you do so at your own risk.
4. Who Can Use MailaAI#
You must be at least 16 years old to use the Services. By using them, you confirm that you are.
If you are between 16 and 18, or under the age of adulthood where you live, you may only use the Services with the supervision of a parent or legal guardian who agrees to these Terms.
If you are a parent or guardian and you let a minor use the Services, you accept these Terms on their behalf. You are responsible for everything they do on the Services, including any content they create, any charges they run up, and any legal responsibility that follows.
5. Your Account#
Some features require an account. When you sign up, please give us accurate and complete information, and keep it up to date.
Your account is your responsibility. Keep your password and login details safe, and do not share them. You are responsible for everything that happens under your account, so if you think someone else has gained access to it, tell us right away.
You can close your account at any time using the instructions in the Services. Closing your account does not cancel anything you already owe us, or any part of these Terms that is meant to continue after the agreement ends (see section 21).
We may also suspend or close your account at any time, for any reason, without notice. Section 21 explains this in more detail.
6. Using MailaAI Responsibly#
Your Permission to Use the Services#
As long as you follow these Terms, we give you permission to use the Services. This permission is personal to you: it is limited, it is not exclusive, and you cannot transfer it or pass it on to anyone else. We can withdraw it if you break these Terms.
Ground Rules#
You agree to use the Services lawfully and in line with these Terms and our other policies. In particular, you must not:
- Break any law or regulation
- Infringe anyone’s copyright, trademark, or other intellectual property
- Defraud, deceive, or mislead others
- Spread malware, viruses, or other harmful code
- Interfere with the Services, or the servers and networks that run them
- Try to access the Services, our systems, or other people’s accounts without permission
- Harass, abuse, or threaten anyone
- Promote hate speech, violence, or discrimination
- Pretend to be MailaAI staff or another user
You also may not use scripts, bots, scrapers, or other automated tools to access the Services or collect data from them, unless we have given you written permission.
What Happens If You Break the Rules#
We may investigate suspected breaches of these rules. If we find a problem, we may remove content, suspend your access, or close your account.
7. Content You May Not Create#
We want MailaAI to be safe, respectful, and welcoming for everyone. That means some kinds of content are off limits. You must not create content in the categories below, knowingly or otherwise, and you must not help or allow others to do so.
Hate Speech and Discrimination#
Content that promotes hatred, violence, or discrimination against anyone because of their race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
Illegal Activity#
Content that is illegal or encourages illegal activity, such as drug trafficking, human trafficking, child exploitation, or terrorism. This also includes supporting or promoting terrorist or extremist groups. We will cooperate with law enforcement when we suspect illegal activity.
Harassment and Bullying#
Content that harasses, intimidates, or bullies others, or that targets people to cause them distress, fear, or humiliation.
Violence and Graphic Content#
Content that promotes or celebrates violence, suffering, animal cruelty, or humiliation, including graphic depictions of violence or gore.
Self-Harm and Eating Disorders#
Content that promotes, encourages, or depicts suicide, self-injury, or eating disorders.
Sexual Content#
Pornographic or sexually explicit content, or content meant to arouse or promote sexual services. Educational and wellness-related content is allowed.
Privacy Violations#
Content that invades someone’s privacy, such as sharing their personal or sensitive information, images, or videos without their clear consent.
Spam#
Unsolicited bulk content, spam, or content created for phishing or spreading malware.
Deception and Disinformation#
Content that is false or misleading, or designed to defraud people or spread disinformation.
Malicious Software#
Ransomware, keyloggers, viruses, or any other software designed to cause harm or take unauthorized control of computer systems.
Medical Advice#
Content that gives medical advice or promotes specific treatments, unless it is created by qualified healthcare professionals. For health questions, please consult a licensed medical practitioner.
Religious Content#
Content that promotes or attacks any religion or religious belief. We aim to stay neutral on matters of faith.
Political Content#
Content intended to influence elections or manipulate public opinion, including political campaigning, lobbying, or propaganda.
Sharing What You Create#
When you share content made with the Services, we ask you to:
- Give appropriate context and credit
- Respect the privacy and consent of anyone shown in the content
- Clearly label AI-generated content so that no one is confused or misled
- Use the content in line with these Terms
We may remove content that breaks these rules. If you break them, especially repeatedly, we may suspend or close your account.
8. Restricted Business Uses#
Some uses of AI can seriously affect people’s lives, rights, and freedoms. For that reason, the Services may not be used for the purposes described below.
Political Campaigning and Lobbying#
You may not use the Services to campaign, lobby, or try to influence elections or legislation. For example, you may not use them to:
- Create or spread content that supports or opposes candidates, parties, or ballot measures
- Raise money for political campaigns or political action committees (PACs)
- Organize political activities or events
- Run fake grassroots campaigns (“astroturfing”)
Secret Tracking and Surveillance#
You may not use the Services to track or watch people without their clear consent. For example, you may not use them to:
- Stalk people or monitor their activities or communications
- Gather intelligence on or investigate individuals
- Use facial recognition or other biometric identification without consent
- Scrape or collect personal data from the Services for tracking
- Support any other unauthorized tracking or monitoring of people
We will review any use that threatens people’s privacy or freedom straight away, and we may cut off access.
Social Scoring#
You may not use the Services to rate or rank people based on their social behavior, relationships, or how trustworthy they seem. This includes judging someone’s credit or reputation, or making decisions about their associations, opinions, or other private matters.
Automated Decisions About People#
You may not use the Services to make automated decisions about people in the following areas:
- Criminal justice, such as parole, probation, bail, sentencing, flight risk, or profiling based on criminal history or demographics
- Finance, such as eligibility for loans, credit, or insurance, investment or lending risk, or any other decision that significantly affects someone’s financial situation
- Employment and housing, such as screening job applicants, hiring, promotions, job assignments, or tenancy decisions
Law Enforcement#
Law enforcement agencies in the United States may use the Services only for limited, non-intrusive tasks, such as:
- Generating leads for human investigators to follow up
- Helping to analyze evidence or data in criminal investigations
- Supporting community outreach and public communication
Any law enforcement use must follow all applicable laws and constitutional protections. The Services may not be used for surveillance, profiling, or other intrusive activities without proper legal authority and oversight.
9. Extra Rules for Businesses#
If you use the Services in your business, a few more rules apply to protect your customers.
Get expert review of professional advice. If you use the Services to create legal, medical, financial, or other professional advice, a qualified professional must review and approve it before your customers see it. You must also make clear that it is not a substitute for personal professional advice, and make sure it follows the laws and professional standards where you operate.
Keep a human in the loop. If you use the Services to talk to customers or to help make decisions, real people must stay meaningfully involved. That means regularly reviewing what the Services produce, giving people a clear way to ask for human review or to appeal automated decisions, and keeping humans in charge of, and accountable for, important decisions.
Tell people they are talking to AI. If your customers interact with the Services directly, you must tell them, at the start and in clear language, that they are dealing with an AI system.
10. Your Content#
What You Own#
The material you put into the Services (“Inputs”) and the content the Services create for you (“Outputs”) belong to you. Together, we call these “Your Content”. We do not claim ownership of Your Content.
The Permission You Give Us#
To run the Services, we need to store, process, and display Your Content. So when you use the Services, you give us permission to use, copy, store, display, modify, and share Your Content, but only to operate, provide, maintain, and improve the Services. This permission is worldwide and free of charge. It is non-exclusive, so you remain free to use Your Content however you like. We may pass this permission on to service providers who help us run the Services, and it continues even if you stop using them.
We Do Not Train AI on Your Content#
We do not use Your Content, whether submitted through our API or any other way, to train, develop, or improve our Services unless you have clearly agreed to it. If we do use Outputs with your consent, we review them carefully first.
Your Responsibilities#
You are responsible for Your Content. When you submit something, you confirm that you have the rights to do so, and that it does not infringe anyone else’s rights. If it includes other people’s personal data, you confirm that you have their permission, or another legal basis, to share it with us. We handle that data as described in our Privacy Policy.
Sharing AI-Generated Images#
If you share images made with the Services publicly, you agree that others may remix, transform, and build on them, including for commercial purposes. If you do not want that, do not share the images publicly.
11. About AI Outputs#
AI is powerful, but it has limits. Please keep the following in mind.
Outputs may not be unique. Because of how machine learning works, the Services may give other users Outputs that are similar or identical to yours, even when their Inputs are different. We cannot promise that any Output is unique or exclusive to you.
Outputs may be wrong. We work hard to make Outputs useful, but we cannot guarantee that they are accurate, reliable, or suitable for your purpose. It is up to you to check Outputs before you rely on them.
Outputs may change. We regularly update our models and features, which can change the style or content of what the Services produce.
Some Outputs may not be protected by copyright. Content generated entirely by AI, content based on our templates or prompts, and content already in the public domain may not qualify for copyright protection. We do not claim ownership of this content either.
12. What We Own#
MailaAI and our licensors own the Services, including the software, models, design, and all related intellectual property. Using the Services does not give you any ownership of them.
Our name, logo, trademarks, and other brand features also belong to us. You may not use them without our written permission. In particular, you may not suggest that MailaAI endorses, sponsors, or is affiliated with you, and you may not present yourself as our agent, employee, or representative.
13. Feedback#
We love hearing ideas for improving MailaAI. If you send us feedback or suggestions, we may use them freely, now and in the future, without paying you or owing you anything.
14. Trials and Extra Terms#
You may be able to try the Services for free before buying a subscription. Trials are covered by these Terms and may have extra limits, such as a time limit or restricted features, which we will tell you about.
Some features or services may come with their own additional terms. If they do, we will show them to you, and by using that feature you agree to them. If those terms conflict with these Terms, the additional terms apply to that feature. You also agree to follow any terms set by our third-party partners or suppliers that apply to your use of the Services.
15. Fees and Payment#
Paying for the Services#
Some parts of the Services are paid. We will always tell you the price before you are charged. Depending on the service, you may pay by subscription (for example, monthly or yearly) or based on how much you use.
You agree to pay all fees for your use of the Services, and to keep your payment details accurate and up to date. Payments are handled by a third-party payment processor. When you pay, you also agree to its terms, and we are not responsible for mistakes the processor makes.
Prices do not include taxes. You are responsible for any taxes or duties on your purchase, such as VAT, sales tax, or withholding tax.
Subscriptions#
Details of our plans, including what each includes and costs, are on our website. You can upgrade or downgrade at any time in your account settings. The change takes effect once payment has gone through.
Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. If you cancel, your subscription stays active until the end of the current billing period.
If a feature needs an extra fee or subscription, we will explain it clearly and ask for your consent before charging you. You can cancel extra subscriptions under the cancellation terms we give you.
Price Changes#
We may change our prices. If we do, we will give you reasonable notice, and the new price will apply from your next billing period after the change takes effect.
Refunds#
New subscriptions come with a 14-day money-back guarantee. If you are not happy for any reason, contact our support team within 14 days of your purchase with your purchase details, and we will refund you in full to your original payment method. The guarantee does not cover renewals or extra services bought separately from your subscription.
Billing Problems and Late Payments#
If you think we have charged you incorrectly, contact us as soon as possible. We will look into it and correct any mistake.
If a payment is more than 30 days late, we may suspend your access until we receive it. We may also charge interest on late payments at 1.5% per month, or the highest rate the law allows, whichever is lower. If we close your account for non-payment, you still owe any fees from before it was closed.
16. Your Privacy and Data#
This section summarizes how we handle your data. Our Privacy Policy has the full details.
What We Collect#
We collect:
- The details you give us when you sign up, such as your name and email address
- The content you upload or create with the Services
- Information about how you use the Services
- Information about your device and browser, collected automatically
- Information from cookies and similar technologies, as described in our Cookie Policy
Who Helps Us Run the Services#
We work with a small number of trusted service providers to deliver the Services. Your data may be processed by, or pass through, their systems. We make sure they meet our data protection standards. Our main providers are:
- OpenAI: AI models. Privacy Policy
- Anthropic: AI models. Privacy Policy
- Amazon Web Services (AWS): Cloud hosting and infrastructure. Privacy Policy
- Vercel: Website hosting. Privacy Policy
Where Your Data Is Stored#
We store and process data in Sweden and in other countries where we or our service providers operate. By using the Services, you agree that your data may be transferred outside your home country, where data protection laws may be different.
Discord#
If you use MailaAI through Discord, anything you send our Discord bot is stored on Discord’s servers and governed by Discord’s privacy practices. We have limited ability to access or delete that data.
How Long We Keep Data#
We keep personal data only as long as we need it for the purposes in our Privacy Policy, unless the law requires or allows us to keep it longer. How long depends on the type of data and why we collected it.
We Do Not Sell Your Data#
We do not sell your personal data to anyone.
Requests From Authorities#
If someone, such as a court or a government agency, asks us for your data, we will try to tell you first so that you have a chance to object, unless the law prevents us from doing so. We may disclose information when the law, a legal process, or a government request requires it.
17. Deleting Your Data#
You can ask us to delete your personal data. We will do so, and tell our service providers to do the same, when the data is no longer needed for the reason we collected it, or when we were using it based on your consent and you withdraw that consent. We may keep some data where we need it for legitimate business reasons or to meet legal obligations.
To make a request, send us:
- Your full name and the email address linked to your MailaAI account
- A clear description of the data you want deleted
- Any other information we need to confirm your identity and find your data
We may ask for more information to confirm that the request really comes from you.
We will confirm that we have received your request within 30 business days and give you an estimate of how long it will take. Most requests are completed within 60 days. If we need longer, we will tell you why and how much more time we need. We will let you know when the deletion is complete.
18. Security and Confidentiality#
How We Protect the Services#
We use industry-standard security measures to protect the Services and your data. However, no system connected to the internet is completely secure, so we cannot guarantee absolute security.
How You Can Help#
Please use strong security practices to protect your login details and prevent anyone else from accessing your account.
If you find a security weakness in the Services, please report it to us promptly. Do not make it public until we have had a reasonable chance to fix it.
Confidential Information#
If we share confidential information with you through the Services, use it only for the purpose we shared it for. Do not share it with anyone else without our written permission, unless the law or a court requires you to. This duty continues after this agreement ends.
19. Changes to the Services#
We are always working to improve MailaAI. That means we may change, update, pause, or stop any part of the Services at any time, sometimes without notice. Changes may affect features, design, APIs, AI models, or the results the Services produce. We will try to tell you in advance about important changes.
We are not responsible for any loss or inconvenience caused by these changes, by a missing notice, or by the Services being unavailable. Like any online service, MailaAI can experience outages, delays, and errors.
For this reason, please do not rely on the Services as your only way to carry out critical tasks. Keep your own backups of important data and have a backup plan in case the Services are unavailable. It is up to you to decide whether the Services suit your needs.
20. Links to Other Services#
The Services may link to websites or services run by other companies. We do not control them and are not responsible for them, and a link does not mean we endorse them. If you use them, you do so at your own risk, and their own terms and privacy policies apply.
21. Ending This Agreement#
This agreement lasts until you or we end it.
You can end it at any time by closing your account and stopping use of the Services.
We can end it, or suspend your access, at any time and for any reason, without notice. This includes cases where we reasonably believe you have broken these Terms or have not paid what you owe.
When the agreement ends, your right to use the Services ends immediately. You must stop using the Services and delete any content you received through them.
Some parts of these Terms continue to apply after the agreement ends, because they are meant to. These include the sections on ownership, confidentiality, fees you still owe, warranties, liability, indemnification, and dispute resolution.
22. Our Responsibility to You#
This section limits our legal responsibility. Please read it carefully.
No Guarantees#
We provide the Services “as is” and “as available”. We do not make any promises about them, whether stated or implied, to the extent the law allows. In legal terms, this means we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In particular, we do not promise that the Services will meet your needs, work without interruption or errors, or be free of harmful components. You use the Services at your own risk.
Limits on Our Liability#
To the fullest extent the law allows, MailaAI and our affiliates, officers, directors, employees, agents, licensors, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. This includes loss of profits, revenue, data, use, goodwill, or other intangible losses.
We are also not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, war, terrorism, riots, embargoes, government actions, fire, floods, accidents, strikes, or shortages of transport, fuel, energy, labor, or materials.
Your Responsibility to Us#
If someone makes a claim against us because of how you used the Services, or because you broke these Terms, you agree to cover our costs. In legal terms, you will indemnify, defend, and hold harmless MailaAI and our affiliates, officers, directors, employees, agents, licensors, and suppliers against any claims, losses, liabilities, damages, and costs, including reasonable legal fees.
23. Resolving Disputes#
Talk to Us First#
If you have a problem, please contact our support team before taking any legal action. Most issues can be solved quickly and informally, and we will do our best to help.
Arbitration#
If we cannot resolve a dispute informally, you and MailaAI agree to settle it through binding arbitration instead of in court, except in the cases listed below. Arbitration means a neutral arbitrator, rather than a judge, makes a final decision.
The arbitration will follow the rules of the Arbitration Institute of the Stockholm Chamber of Commerce and the Swedish Arbitration Act. It will take place in Stockholm, Sweden, in English, and it will be confidential. The Institute’s rules decide how filing, administration, and arbitrator fees are shared. Each side pays its own legal fees and other costs, unless the arbitrator decides otherwise under the law.
Exceptions#
Claims about copyright or other intellectual property, and requests for a court order to stop someone from doing something (an “injunction”), can go straight to a Swedish court. They do not have to go through arbitration or the informal process first. Any other dispute that does not go to arbitration will also be decided by the courts of Sweden.
No Jury Trials#
YOU AND MAILAAI GIVE UP ANY RIGHT TO A JURY TRIAL in any dispute about these Terms or the Services.
No Class Actions#
Each dispute must be brought individually. You cannot join a class action, or combine your claims with those of other customers or users, in arbitration or in court.
Which Law Applies#
These Terms and any disputes about them or the Services are governed by Swedish law, regardless of any rules that would point to the law of another country.
24. Copyright and Trademark Complaints#
Reporting Infringement#
If you believe that content on the Services infringes your copyright or trademark, you can send a takedown notice to our designated agent. Your notice must include:
- A description of the work you believe has been infringed
- A description of the content you believe is infringing, and where it appears on the Services
- Your name, address, phone number, and email address
- A statement that you believe in good faith that the content is being used without the owner’s permission
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act for the rights owner
- Your physical or electronic signature
Disputing a Takedown#
If you believe your content was removed by mistake, you can send a counter-notice to our designated agent. Your counter-notice must include:
- A description of the content that was removed, and where it appeared on the Services
- Your name, address, phone number, and email address
- A statement, under penalty of perjury, that you believe in good faith that the content was removed by mistake or misidentification
- A statement that you accept the jurisdiction of the court for the area where your address is located
- Your physical or electronic signature
When we receive a valid counter-notice, we will promptly forward it to the person who sent the original complaint. If they do not tell us within 10 business days that they are seeking a court order, we may restore the content.
25. How We Contact You#
By using the Services, you agree that we may contact you electronically, for example by email or through notices in the Services. Any agreement, notice, or other message we send this way counts as being “in writing” for legal purposes.
From time to time, we may send you announcements and updates about the Services. You can opt out of these by contacting our support team.
26. Other Legal Terms#
This section covers the remaining legal details that keep this agreement working.
This is the whole agreement. These Terms, together with the policies they mention, are the complete agreement between you and MailaAI about the Services.
Transferring the agreement. We may transfer our rights and obligations under these Terms to another company without your consent. You may not transfer yours without our written permission.
If part of these Terms is invalid. If a court finds any part of these Terms invalid or unenforceable, the rest stays in effect. The invalid part will be replaced with a valid one that comes as close as possible to the original intention.
Not enforcing a right is not giving it up. If we do not enforce part of these Terms straight away, we can still enforce it later. We only give up a right if we do so in writing, signed by an authorized representative.
Court orders to protect MailaAI. If you break these Terms, it could cause us harm that money alone cannot fix. In that case, we may ask a court to order you to stop, in addition to any other remedies.
Following the law. You agree to follow all laws that apply to your use of the Services, including data protection, privacy, and import and export laws. We may disclose information when the law requires it, and we may edit, refuse to publish, or remove any content at our discretion.
Export controls and sanctions. The Services may not be exported to countries, people, or organizations that are barred from receiving exports from the United States or Sweden. By using the Services, you confirm that you are not located in such a country, and are not on any such list. You agree to follow all applicable US and Swedish export and sanctions rules.
US government users. The Services are provided to the US government as “commercial items”, “commercial computer software”, “commercial computer software documentation”, and “technical data”, with the same rights and restrictions that apply to everyone else. If these Terms do not meet the US government’s needs or conflict with US federal law, you must stop using the Services.
Our relationship. These Terms do not make us partners, employer and employee, or agents of each other, and do not create a joint venture. Neither of us can make commitments on the other’s behalf without written permission.
No rights for third parties. Only you and MailaAI can enforce these Terms.
How to read these Terms. Headings are only there to make the Terms easier to read and do not change their meaning. Words like “include” and “including” mean “including, but not limited to”. Unclear wording will not automatically be interpreted against MailaAI just because we wrote these Terms.
27. Definitions#
These are the key terms used in this document:
- “MailaAI”, “we”, “us”, “our”: MailaAI, the company that provides the Services.
- “You”, “your”: the person or organization using the Services.
- “Services”: all of MailaAI’s websites, apps, APIs, software, and tools.
- “Inputs”: the text, files, and other material you submit to the Services.
- “Outputs”: the content the Services generate in response to your Inputs, including text, images, audio, and video.
- “Your Content”: your Inputs and Outputs together.
- “AI-generated”: content created, in whole or in part, by an artificial intelligence model.
Thank you for choosing MailaAI. By using the Services, you confirm that you have read, understood, and agree to these Terms of Use. If you do not agree, please do not use the Services.
